Alexico hit with $197M suit at Flatotel

Alexico Group is facing a $196.7 million suit at the Flatotel, after Atlas Capital accused the developer of defaulting on the property’s mortgage loans. According to the lawsuit, filed in New York State Supreme Court yesterday, Alexico borrowed $158 million from Anglo Irish Bank in January 2008 to develop the property, located at 135 West 52nd Street. But the developer allegedly failed to make three consecutive interest payments on the loan starting in January 2009, and was notified of the default. The complaint alleges the developer then failed to make additional payments between April 2009 and July 2010, leading the lenders to accelerate the payments due and call in the entire loan. [more]

SL Green to gain $66M from 510 Madison

SL Green Realty is expected to gain $66 million profit on the sale of 510 Madison Avenue, according to a report from FBR Capital Markets cited by Nasdaq. The real estate investment trust owned $280.5 million of senior and mezzanine debt on the property that was paid in full when Boston Properties acquired the building from Macklowe Properties last month. Boston Properties paid about $316 million, or about $904 per square foot, for the vacant Midtown property. [more]

BlackRock to assess industry’s CMBS losses

Investment management firm BlackRock was hired by state insurance regulators to evaluate the industry’s potential losses from holding commercial mortgage-backed securities, Bloomberg news reported. By the end of the year, BlackRock will review more than 7,000 securities, the National Association of Insurance Commissioners said yesterday in a statement. The New York-based firm will calculate loss expectations for the holdings, which will determine how much capital insurers must hold to cushion potential declines, NAIC said. [more]

A stalled waterfront project at 11 Broadway in South Williamsburg is being revived by L+M Development Partners and Goldman Sachs Urban Investment Group, with both parties closing this week on financing for the mixed-use development site, Crain’s reported. The project will include 134,000 square feet of residential space, 27,000 square feet of retail and commercial space, plus 29,000 square feet underground for parking. "You could literally have lounge chairs up in the air and in the pool," Desiderio said. The priciest Manhattan home to hit the market this week is an eight-bedroom co-op in the Brentmore, at 88 Central Park West in Lincoln Square, according to Streeteasy.com. As The Real Deal first reported, the 14-room, two-floor residence, on the market for $25 million, belongs to heiress Laurie Tisch, who is moving to the 834 Fifth Avenue co-op she bought last year for $29 million. The building, designed by architectural firm Schwartz and Gross, was completed in 1910 but recently underwent a restoration, and now has a library, den, wet bar, central air conditioning and a modern sound system. Cindy Kurtin and Jessica Vertullo of Stribling & Associates have the listing. The cheapest Manhattan unit to come online this week is a one-bedroom, one-bathroom co-op at 516 East 78th Street on the Upper East Side. Quinn receives thousands in Vornado donations through campaign finance loophole

City Council Speaker Christine Quinn has received thousands of dollars in campaign contributions from Vornado Realty Trust through a loophole in campaign finance regulations, despite publicly praising a three-year-old law that was supposed to limit the amount that individuals doing business with the city are allowed to contribute to $400 each. According to Crain's, Quinn received $19,900 from Vornado executives, nearly $15,000 of which is being held in an account saved for her expected 2013 mayoral campaign. The donations began coming in around the same time the city began building a database of companies doing business with the city as part of the new campaign finance law, which passed in 2007. Last week, the City Council approved Vornado's proposed skyscraper at 15 Penn Plaza with Quinn's support, despite resistance from Community Board 5. [more]

Columbia University is seeking to acquire more land along the Harlem River to legally construct a new sports complex at Broadway and 218th Street in Inwood, DNAinfo reported. A city law requires property owners on the Manhattan shoreline to set aside a predetermined percentage of the land for public use when building a new structure, but since Columbia doesn’t have the required amount, it is asking the city to allow it to acquire and develop additional space. To build the planned five-story, 48,000-square-foot Steven Holl-designed Campbell Sports Center, the school would normally have to set aside 180,000 square feet of additional city-owned public waterfront space, according to Wayne Benjamin, Community Board 12's land use chair. Summer started slow, but brokers saw uptick

From the September issue: The National Association of Realtors reported last month that home sales nationwide dropped by 27 percent between June and July -- a phenomenon largely attributed to the expiration of federal housing tax credits. The bleak news sent the stock market into a nosedive and gave more credence to the national conversation about a possible "double-dip" recession. Yet Manhattan real estate brokers said they're seeing an increase in activity as the summer draws to a close, suggesting a strong fall market may be in the works. "Business has been building," said Frances Katzen, an executive vice president at Prudential Douglas Elliman. "People are buying through the summer months and property is moving. This is a far cry from last summer." Ryan Fitzpatrick, sales associate at the brokerage CORE, said that in light of the strength of demand this summer, he "expects the market will be robust through the fall. [more]

Real estate has been the top-performing U.S.-stock fund category this year, through August, with a 13.7 percent total return, according to Morningstar, compared with a negative 4.6 percent for the Standard & Poor's 500-stock index over the same period. Newly scheduled residential foreclosure auctions rose by 90 percent in Staten Island last month, reversing the dip seen in July and prolonging the borough’s year-long pattern of dramatic ups and downs, according to new data from PropertyShark.com. Still, the borough’s 38 scheduled foreclosures, up 111 percent since last year at this time, were just a small fraction of the 139 scheduled in Queens in August, which continues to lead the city by far in terms of new home foreclosure volume. Queens’ foreclosure auctions first scheduled during August were up 11 percent month-over-month and 1 percent year-over-year. Of the top 15 zip codes in the city for scheduled foreclosure auctions last month -- including both those just scheduled in August and those scheduled previously -- the first 13 were in Queens. The Department of Citywide Administrative Services has signed a lease for 81,800 square feet at 2 MetroTech Center in Downtown Brooklyn, where the asking rent was $35 a square foot, Crain’s reported. The space, which is under a 20-year lease that officially began in May, will be used by the city's Department of Information Technology and Telecommunications for offices and a data center. A build-out of the space is expected to begin this week and the agency is slated to move in during the first quarter of next year. [more]

July's $805 billion annual spending rate was 1 percent below June's $813.1 billion rate and 10.7 percent below the $901.2 billion level recorded in July 2009. The private residential construction sector, which has been battered by gloomy reports since the expiration of the federal homebuyer tax credit in June, saw a 2.6 percent decline in spending -- to an annual rate of $240.3 billion -- since June but a 5.5 percent increase over July 2009. Elected officials and advocates praised a new law passed by the City Council last week that requires far more disclosure from apartment building investors, and predictably, real estate insiders criticized it as overkill. Yet there is one puzzling question with the new law: It was justified by and based on a decades-old law that the city has not adhered to in years. In the 1980s, when real estate investors were snapping up single room occupancy hotels and converting them to standard apartments, the city passed legislation that required individuals who own more than 25 percent of an SRO to register with the city’s Department of Housing Preservation and Development. However, for at least nearly 20 years, the agency has never tabulated the information. In fact the current form the city uses for the required registration of multiple dwelling buildings does not even contain a field to enter such data (see the registration form after the jump). An official from HPD made the surprising admission in city council hearings in June that its computer system, called Premises, would have to be reprogrammed to contain the additional data. [more]

Jay Suites has just inked a deal for its fourth New York City location, at 30 Broad Street in the Financial District, company President Juda Srour told The Real Deal, and is scouting out sites in Chelsea and the Plaza District for three more locations. Jay Suites -- a business suites provider which rents out fully furnished office spaces to both corporate clients and small businesses -- signed a 13-year lease last Tuesday with Gotham Holdings for the entire 14th floor of the 50-story building at the corner of Broad Street and Exchange Place, which is adjacent to the New York Stock Exchange. The 16,000-square-foot space will be fully renovated and ready for lease by Dec. 1, Srour said. Rents will range from $800 a month to $4,000 for office spaces of 100 square feet to 3,000 square feet. Century 21 will take over the following month in preparation for a grand opening in Fall 2011, said Cushman, which brokered the deal. Meanwhile, the move sets the stage for a discount retailer showdown on the Upper West Side, with Loehmann's -- already rumored to be in dire financial straights -- vying to retain its customers at 73rd and Broadway and T.J. A new deal is being negotiated for the West Shore waterfront parcel in Staten Island, according to ISC spokesperson Charles Talbert, but the future remains uncertain for the 676-acre site, the largest privately owned piece of undeveloped industrial land in the city. Last year, ISC announced it was in contract to sell the site to KB Marine for $80 million, nearly $30 million less than ISC paid to assemble the former oil tank farm in 2004. [more]

The Olde Towne Association unveiled its completed 50-acre historic site today, with seven building parcels in Southampton Village asking $81.5 million. The individual lots, each on roughly four acres, are available from $10.5 to $13.5 million, including some with second-floor pond and ocean views. “The developer crafted a visionary plan which is among the most rarified settings in the Hamptons,” said listing broker Andrew Saunders of Saunders & Associate. The developer -- only the seventh titled owner in 370 years -- is Bob Gianos, founder and president of East End Properties, who is working together with land planner Hart Howerton. [more]

Shiller urges new approach to housing crisis

Policy makers need to be more “inspirational” when designing solutions to the housing market crisis, according to Yale economist Robert Shiller. Shiller noted that it did not make sense to extend the homebuyer tax credit, and that the responses by the Bush and Obama administrations have amounted to “patches and bailouts,” he told the Wall Street Journal. Shiller believes that the solution lies in more “forward thinking” measures. One suggestion he offered was that mortgages should be indexed to inflation to allow for greater long-term certainty for borrowers. [more]

Jeffrey Brooker, 25-year Harlem real estate veteran, dies

Jeffrey Brooker, a pioneer of Harlem real estate and president of residential and commercial firm Webb & Brooker, passed away last Friday at the age of 55, after suffering an unexpected heart attack. Brooker, a commercial real estate veteran, began at Webb & Brooker, where his father was president, as an agent in 1985. Following his father's death in 1993, Brooker stepped into his shoes, becoming president. An avid community advocate, Brooker was a fixture in his community, serving as a member of numerous local organizations including the Upper Manhattan Empowerment Zone Development Corporation, the Harlem Business Alliance and the 125th Street Business Improvement District. Brooker was also a member of the Real Estate Board of New York for more than 30 years, according to REBNY President Steven Spinola, who knew Brooker well. [more]

Governor David Paterson signed into law today several amendments to the state’s real estate agency disclosure law that will increase transparency in the real estate process and offer increased protection to consumers and real estate brokers. The amendments, to take effect Jan. 1, 2011, will require that agency disclosure forms be completed for all residential transactions. Previously, verbal consent for agency disclosure was accepted for multi-family buildings with over four units. The new law specifies that a written agency disclosure form must be used for all residential transactions. [more]

Old Forward newspaper building selling for $20M, to become condo

The long-time home of the Jewish Daily Forward newspaper and a Jewish social service agency is in contract with developer Craig Nassi's BCN Development, which plans to build 108 condominium units at the site near the Empire State Building. The developer has inked a deal to buy the six-story Workmen's Circle building, at 45 East 33rd Street, between Park and Madison avenues, Nassi told The Real Deal. Several sources put the price at approximately $20 million. The building would be delivered vacant. The property was tied up in litigation for nearly a year after a development entity called Empire 33rd LLC, which included the builder of the Toren condominium in Brooklyn, Donald Capoccia, failed to conclude the purchase of the building after signing a contract in March 2007 to buy it for $34.9 million. Paterson signs bedbug legislation into law

Governor David Paterson signed legislation into effect today requiring landlords to disclose any history of bedbug activity in a building to possible tenants. The move comes on the heels of an increasing number of bedbug complaint calls to 311 in New York City -- 11,000 such calls were made last year, compared to just 537 in 2004. The "Bedbug Disclosure Act" was sponsored by New York State Assembly member Linda Rosenthal, whose district includes the Upper West Side and portions of Hell's Kitchen. After a year with no sales, an Upper East Side condominium is hitting up a third marketing team, and slashing asking prices roughly 30 percent in an attempt to move units. Two Prudential Douglas Elliman agents have signed on to represent the five-unit building, 1055 Park Avenue, which has failed to sell any of its units since sales launched in May 2009. Pricing at the project had been a source of contention since its inception, sources told The Real Deal, with previous marketing teams from Sotheby's International Realty and the Marketing Directors butting heads with developer Trevor Davis over how to properly price the units. Narrow second quarter loss for Cushman

The red ink slowed in the second quarter for the world's third-largest commercial services firm Cushman & Wakefield, as revenues increased, its Italian parent company Exor said. The net loss at Cushman shrank to $2.4 million in the second quarter, down from $22 million in the same period a year earlier, Exor reported on its website Friday. Revenues rose by 16.5 percent to $414.5 million in the second quarter, up from $355.8 million in the same period last year. Cushman's rivals CBRE and Jones Lang both reported profits on double-digit revenue growth in the second quarter. "Taking into account the seasonality in [the commercial real estate] business cycle that historically presents lower results, or losses, in the first two quarters of the year, as compared with the second half of the year, [Cushman] has shown a strong revenue performance in the first half of 2010," the Exor release said. The effects of the economic downturn are being felt by developers citywide, but some are faring better than others. Though hotel and restaurant developer Sant Singh Chatwal and his son, Vikram, suffered from bankruptcies and lenders’ lawsuits in the last commercial real estate collapse, they seem to be recovering well, the Wall Street Journal reported. The Chatwal Hotel, an 83-room, $100 million-plus project in a landmark building in the Theater District is set to debut Wednesday. The Chatwals also plan to open hotels in Chelsea, Noho and Miami's South Beach, modeled after two of their Times Square boutique hotels, the Dream and the Night. [more]

[Update: 2:29 p.m.] A new website is calling out 153 landlords whose buildings are allegedly so dirty or unsafe that they have earned a spot on the city's list of shame. Among them is Alan Fein -- whose Bronx tenants live with urine-soaked hallways, crackhead squatters and rat-infested toilets -- and Chris Grijalva, whose roach-infested Brooklyn building has a giant pile of garbage on the front lawn. Unsurprisingly, data from the new site shows that many of the apartment buildings on the watch list are located in the city's poorest areas. In Manhattan, all but one of the landlords' properties are located above 119th Street, while Bushwick, Crown Heights and East New York are among the Brooklyn neighborhoods with frequent housing code violations. The South Bronx is also dotted with New York's so-called "most irresponsible landlords." [more]

Midtown hotel borrows from neighbor

From the August issue: This is not a propitious climate in which to build hotels, and yet a mysterious sliver of a hotel has just arisen in Midtown, at 16 East 46th Street, between Fifth and Madison avenues. New information shows that it's scheduled to be a boutique, the Gotham, which contains 66 units in its 22 stories, while occupying a single lot no wider than the townhouse that once stood at this site. According to the architect of the project, Damir Sehic of C3D Architecture, most of the furniture has been moved into the hotel and the restaurant on the first floor. Work on the hotel, developed by R+B Development (after Refik Radoncic and Jeffrey Bennett), may finish next month. The name of the new hotel requires some explaining. It is intended to invoke the Gotham Book Mart of sacred memory, which occupied this site until it folded in 2007 (although it was resident-only for five years, after moving from 41 West 47th Street, where it had been for more than half a century).
